Will It Work?
The vast majority of cases that are taken to mediation settle as a consequence of the mediation, either during the mediation itself or shortly afterwards. However, there are no guarantees that a solution will be reached. Even if a solution is not reached, the process is usually helpful in clarifying the issues involved.
If after the mediation the parties have not reached agreement and wish to take the case further, they are entirely free to. Information divulged during the course of a mediation is “without prejudice”. This means it cannot be used in any other proceedings.
